Description:

Back in the 90s the City of Dallas, charged the owners of the residences on Victor Street to create an alley. They cut into my property so the alley would slope, but then didn't build any retaining wall - just a short curb. Its cracking and giving way. The rebar (should be covered with cement) is exposed and the the area that is grated is giving way to area beneath. My soil is coming through the cracks and since my Garage is 2,000 sq ft the weight I'm concerned. The City and/or it's contractors did not properly build the drain, curb or retain my soil on my property. Slowly over the years, erosion has occurred which resulted in me (after contact the city) a retaining wall, at my expense. Now the cement, drain, rebar and curb are all giving way and giving way to the drain below. My 2,000 square foot garage is within 5 feet to this area. I called the Director's office and pleaded to the Assistant, Karen Plunkit, that Ms. Nix personally talked to me before this escalated. I left numerous messages but alas she had the manager of District 5 (name in my office computer) to take care of the matter. He assured me that he would have a name of a person that was responsible to fix it by 03/24/10—I still haven't heard from him. My intent is to sue for damages if no response in 30 days.

How are things going? Did they fix it, or did you have to start a lawsuit?
