Description:

I answered an ad for a job at a restaraunt in Bethlehem PA.Set up and worked at the restaraunt for 2 months.Collected two paychecks,since we were told we would be paid every two weeks.Tom Kilduff then could not pay us ,claiming he was waiting on a city backed loan for the business.Abruptly closed and removed all his equipment over the memorial day weekend(5/28/2010).owes me1066.75 dollars for 146 hours of work.Then he went on a 10 day jamaican vacation,saying he has no money to pay me.....

i m working in a resturant before last year to this year august,2011. due to owner toucher and problem on my health, i left that job but i have two weeks deposit as well as 2 weeks wages, when i ask about wages .He told me " i cant pay u what you like to do ?he challenge me .
In this case what is better for me ? now i m very much trouble i how can i took my money from him.
plz suggest me

Tom Kilduff did come thru!! He paid me on 12/19/2010,in full....

business owner is filing bankruptcy...Labor law compliance board cannot do anything.Now i will get in line with the other people he owes.If your boss is TOM KILDUFF,quit your job or get paid daily LOL...

In addition to Kim's excellent suggestions, make sure you keep all your work records safe -- don't lose any of them because they'll be helpful in proving your case.

If you know of other co-workers who weren't paid, they could be helpful in court as witnesses about when you worked there (and you could also be a witness for them in the same manner should they choose to file suit). Credible witnesses can make a big difference in the success of your case, especially if they were treated the same way you were.

Also, filing a report with the local police department might be helpful too. If there's a local government department of labour standards, you should definitely speak with them.

Thanks for those tips...There are about 10 of us in the same boat..The others dont seem to be as proactive as me..I dont want this jerk to try to open another business and get away with this.The lawsuit is my last resort...I was hoping the labor board would stand behind us workers..Also ,Kilduff CLAIMS he is filing bankruptcy...Should that change my approach to this matter??

Kilduff claims (I'm not sure what that is, but it sounds serious), bankruptcy filings, etc. Should that change your approach? I think that because of the time-sensitive nature of this that talking to a lawyer or even the Attourney General (especially because there are 10 of you having this problem -- all 10 should show up in the A.G.'s office all at once as this will surely grab his/her attention) immediately would probably be a very good idea.

That sucks. Have you tried the attorney general's office here in PA? They might be able to do something for you and help you get your money. You then have the option to civily sue him in private small claims court and a judgement can be entered against him and that will follow him until he owns up to you. If you know were he banks that would be an aplus in your bag. They will attach a garnish to his pay and he will not be able to get any of his assets until he pays you. My heart goes out for you. Thank you...attorney generals office referreed it to Labor law compliance..They called him an he is hiding behind bankruptcy laws.....

owner did not go on vacation anywhere and he kept his word about paying his employees when he got money, which he did.
